 Retiring from the rank of Police Constable after rendering service for law enforcement agency for 27 years, our General Manager Tamer Gür established ADT Detective in 2007 which is one of the first commercial Detective firms of Turkey and offered his professional knowledge and experience for the service of private sector.

Our General Manager Tamer Gür was born in Istanbul in 1965. He respectively completed his academic life in 1984 Police College, 1988 Police Academy, 1990 Düsseldorf Geothe Institute. Our General Manager which is equipped with Drug Enforcement Administration (DEA), Smuggling and Intelligence is our reference and your assurance as a person who has achieved countless results in services such as Narcotic, Organizes Branch Office in Smuggling units.

In our country there are people who carry out Detective profession due to the official work they do. These are Judicial Detective, Medical Detective and Police Detective.

Police Detectives are comprised of Police Commander and Police Officers who graduate from Police Academy-Faculty of Security Sciences, Police-Professional Colleges.  And also for the commanders and officers to be able to specialize in their working area, each unit organizes an in-service training within themselves.

WORKING METHOD OF THE DETECTIVE

DEDEKTİFLİK

First of all, Detective must specify the objective, scope and result parts of the study he has been authorized for and he will execute.

These specifications will also put forward the moral and legal situation of the detective service that is being carried out.

As a result, durations and costs of the study must be specified as detective service is a commercial activity. . After this basic analysis, the study methods to be used for the detective service must be put forward.  

 As each case will differentiate within itself, working method to be applied in the detective work service will be different and the resources to be used in turn shall differentiate. Within this framework, detective can make a method change according to current developments while carrying out the detective research he has initiated. Detective specifies this situation by making evaluations during the working period.

 Here what the detective must pay attention to is the correct evaluation of the study and the information-document that is found out. Correctly executed detective service, reporting of each level of the activity and the confirmation of the information and document used within the scope of the report is essential. Requirement of the executed detective service is to protect the reports and comply with the confidentiality. Criteria to be specified by us regarding the confidentiality in the executed detective service may differentiate according to the current risk.

It is required for a detective to put the detective work in such a way to present to the customer.

WHAT A DETECTIVE NEEDS TO KNOW ABOUT THE SERVICE

1. He must have a command of law and legislation containing the service area.  
2. He must know the interrogation and research methods.  
3. He must be able to evaluate the feasibility of the work, specify the working method and explain it to the customer.  
4. If required, he must be able to specify new working methods.
5. He must be able to explain the methods to be applied and current risks to customer.  
6. He must be able to carry out his works in a confidential and secure way.
7. He must be able to make reporting, analysis and evaluation about the work carried out and to present it.  
8. He must work in a customer-oriented way and present his work.

FIRST SECTION:
Objective, Scope, Basis and Definitions: 

Objective:
Article 1-Objective of the legislation is to regulate the working principals and methods and professional ethical rules in parallel with the Legislation of Private Detectives, Consultants, Researchers and Security Protectors' Association of the Private Detectives Association members.

Scope:
Article 2- This Legislation contains the working basis and methods and professional moral rules of the Private Detectives Association members.

Legal Basis:
Article 3-This Legislation has been prepared based on the Private Detectives Association Legislation and General Assembly Rules and Central Management Rule with the Turkish Civil Code numbered 4721 and Association Law numbered 5253.

Definitions:
Article 4- These terms are mentioned in this Legislation and their meanings are given as follows: 
Private Detective: Commercial Company Owner or Responsible,
Private Researcher: Personnel working under the responsibility of Private Detective in the commercial firm.
Association: Private Detectives, Consultants, Researchers and Security Protectors' Association
General Assembly: Private Detectives Association Ordinary or Extra Ordinary General Assembly
Board of Executives: Private Detectives Association Central Management Board
Inspection Board: Private Detectives Association  Central Inspection Board
Corporate Member: Corporate Member of the Association as a Commercial Establishment
Member: Individual Member of the Association

SECOND SECTION:
Article 5-Tasks and responsibilities of Private Detectives Association:

• As Private Detectives Association, our objective is to work in cooperation with our colleagues who have adopted moral rules and who are suitable for the professional honor, to enable the Legal struggle to be formed on a correct basis through commissions to be established under the association and to make enterprises  regarding Government, Establishment and Associations by creating a public opinion for an immediate legislation of a law for the Private Detective Services which is an essential need in our society and to put forward ideas recommendations and to enable the legislation of Private Detective Law by being a side.     
• Improve social cooperation and solidarity spirit of the personnel working in this area and the commercial establishments rendering service in the areas of Private Detective, Consultancy, Research and Security and to cultivate their professional, social and cultural improvements,
• To increase the awareness of our members rendering service in this sector on the basis of science, academy and law and to realize all kinds of studies in country and abroad in accordance with this objective. For the formation of professional rules, enabling the formation of moral rules on the basis of human rights and respect for private life,
• Considering research services as a whole and collecting all the personnel rendering service in Detective, Consultancy, Research and Security areas under one roof, finding solutions for the professional problems, creating more healthy and functional working environments, making all the parties comply with moral rules and specifying competing factors and working for their practice.
• Cooperating with all associations, chambers or federations operating with the same objective, enabling the formation of professional education programs by making enterprises regarding Universities or Colleges
• Making all kinds of legal enterprise on behalf of its members in compliance with the aims and principals of the association and being a side against third parties, suiting when representation is required. 

THIRD SECTION:
Duties, authorities and responsibilities of association members
Article 6-Duties and authorities of a private detective:

• Investigating if family members are prone to bad habits and damaging behaviors against family unit.
• Finding lost people or people the addresses of whom are unknown, detecting their addresses.
• Finding lost or stolen items
• Investigating the honesty, reliability of a top executive or a representative personnel of all kinds of Commercial establishment, their attitudes towards the employer and if they cooperate with other firms and establishment against the employer.
• Researching all distributor, agency, representative and branches bound to any commercial establishment to see if they comply with the articles or commercial conditions stated in the agreement.
• Researching and detecting what the rights and receivables are of the third parties together with the movable and immovable assets of the debtors against whom follow-up is made in bankruptcy/debt offices.
• They are responsible for executing their duties in areas of accident, blackmail, fake accounting, family law, forgery, fraud, loss, intellectual property right, Legal support, Detection of nationality, recovery, Status Reports, Observation and Follow-up, Theft researches, Tracking researches according to the provisions of Turkish Criminal Code and Civil Code.

Article 7- No information disclosure and the principal of giving correct information:

Private detective offices can not disclose to anyone any information that they receive as a result of special works. He/she can not disclose a secret to anyone other than the customer. But if it is found out that a crime has been committed, he/she is responsible for reporting the place of information and documents to public prosecution Office. Private detective offices can not give false information or report to their employers or customers.

Article 8–Professional Responsibilities of the Private Detectives Association Members

• To carry out all his professional duties in compliance with supreme moral rules principal and never behaving in a way to make private detective profession look guilty.
• Not to make any researches which do not have any legal or moral basis.
• To carry out all the researches within the legal, moral and professional ethical borders.
•  Confirming the reliability of the customer and to detect that there are legal and moral reasons to initiate the research.
• To comply with the customer confidentially and legal confidentiality of the information and documents found out.
• Respecting the interests of our customers by expressing supreme service standards and by enabling the reporting of all the phenomena to the customers and protecting them in parallel with legal requirements.
• Enabling the security of services and records in a way to protect customer confidentiality and protect the private information in a way that they are not misused.
• Not to use the information and documents found out as a result of the research to gain interest or to damage the customer.
• Making al the personnel or the other people who are helping the research against fee comply with the Ethical Rules.
• To cooperate with all professional members fpr the execution of private detective profession in the highest objectivity, correctly, properly and honestly.

Article 9-Working Principals:

·         Private Detective is responsible for making agreement containing the identity information, addresses, and commercial titles of the customer receiving the service and the parties, business subjects and durations and where the articles protecting the confidentiality principals and mutual rights and interests are openly written.

·         It is compulsory to write in the agreement the price including all the expenses and to openly indicate that all the works within the scope of the research will be completed and submitted on time.

·         Private Detective has to report and present to his/her customer all the information and all the details about the subject he/she found out during the beginning and ending periods of the research subject.

Article 10-Identity and Membership Document:

This Legislation is signed by the Members of the Association and the Central Board of Directors confirms. Identity card is given to private detectives and private researchers indicating the association they are related with, their authorities, position and identity information. Corporate Membership Document is also given to the Corporate Members of the Association showing that they are the member of association.

Article 11-Sanction and Punishment:

Members of Private Detectives Association commits to unconditionally comply with the decisions od Central Board of Directors and Association’s Legislation and the rules stated in this legislation. Inquiries shall be initiated by Central Board of Directors for the members who do not comply with the specified working conditions and responsibilities. If it is detected that the crime is constant, punishment of warning or dismissal from membership is applied according to the level of crime and it is disclosed to public.

Article 12- Enforcement:
This Legislation is enforced on the broadcast date of this Legislation.

Article 13- Execution:
Provisions of this legislation are executed by Private Detectives Association Centreal Board of Directors.

HOW TO BECOME A DETECTIVE

Your personality must be mature enough. A person who is skeptical, analyzer, able to look at a subject from different points of views can be a good detective and for contemporary detectives a good detective has to know technology well, human psychology, read a lot, be able to analyze regarding where he can find the information and he has to be observer, not hidebound and imaginative.

What a private detective does?

Private detectives legally or physically applied for by people undertake the following:

To find out information or evidence in cases or private cases and to disclose them. Research of the crimes which can be followed by one of the legitimate parties in the process regarding the crime. Based on this article hereby investigation of the cases in the areas of economy, business, commerce, finance and generally personal, family or social or special cases. Detective work expected to be legal within this year in Turkey is preferred by retired police. While there are almost 300 detectives in Turkey working by paying their taxes, half of them are comprised of retired police.

General Manager of ADT Detective which is found in Istanbul, 4th class Police Constable Tamer Gür states that all the employees working in his firm are his colleagues. Also the founder of Maviay Detective states that detective work is mostly preferred by retired soldiers after retired police.

As this is the case, General Directorate of Security prepared a book called "Private Detective Law Practices in Turkey" 4 months ago. How detective work is handled in law in USA and in many other European countries is examined in the book. How these laws can be applied to Turkey is discussed. In USA, there is a ‘detective work office police department’ under police department. Ismail Yetimoglu who has also been carrying out Private Detectives Association directorate emphasizes that there is a need for this also in Turkey. Association has been preparing a ‘educational curriculum'. For this, a legislation studied on detective work in England has been purchased for 250 pounds. It has been translated to Turkish and has been adjusted to Turkey by help of lawyers and academicians.

Last year on this page, I have written an article titled "Private Security Protectors versus Private Detectives" and stated that associations without a legal legislation opened a detective work course.

First of all, let me correct a mistake in the article through warning of my friends in Community Centers: Course has not been prepared in Kadıköy Community Centre but in Kadıköy Public Education Centre. For the sake of rightness principal, I have also included the explanation of Private Detective Association in the article. However Yusuf Vehbi Dalda, vice president of the association has sent me a long explanation. He says that the discussion is caused by a "personal anger". He says that "For 10 years, I have rendered service for private detective work. I can not argue with Private Security Protectors".

He also states that the course is not a commercial activity. “and it is a kind of in-house education for Private detective work companies and personnel” and he adds: “As Detective work has not been handled with its all aspects in our country, somehow it has generally always been regarded as a profession about spouse cheating. However this subject includes only 5-10 percent of all activities. Activity scope of detective work is much wider. (..) This is not an ambition; it is a compensation for a need that occurs. This period in detective work can be compared to the status of televisions before RTUK (Radio and Television Supreme Council). In parallel with the process on the world, also law of this profession will have to be introduced. In these events, our association has been unjustly behaved and has been accused. All the rights including right of reply will be used against relative events and persons."

Detectives Association General Manager Assistant, old Police Constable Tamer Gür states: “Actually as eager for detective work has been increasing it is an important subject… While the proper realization of service arising from natural needs is not a problem, there is a problem on the point how and by whom this service is being rendered… As there is not law, incapability of those rendering detective service and the incompetence in the service quality are the things required to be improved: “Gür explains what kind of detective services their customers demand with these examples: "Big companies in our country, domestic and foreign brands receive service due to problems they encounter through brand forgery." Banks receive research service with credits beyond limit and the feedback provided to economy thanks to confidential customer researches are of significant numbers. When we look at the case from the point of individual services, the situation is not so different: Little daughter of the divorced couple is taken from her mother by her father every 15 days via court decree. Father addicted to drugs spends the weekend in coffee house with his 5-year-old daughter. The girl was rescued from this situation as a result of the fact that it has been detected and monitored. The father lost his right of seeing her daughter for now. Many cases like this...

“Spouses cheating on each other and the subsequent problems… Traumas experienced by children and spouses who are cheated are even more desperate than the results occurring after the relationship is disclosed… Maybe the only way of depressed spouses and psychologically disrupted children to be able to set out their lives, to prove themselves before court and public, to be able to receive their material and moral rights are the information and documents presented to them by private detective.

Corporate detective services are becoming more common in Turkey. Companies receive detective service for several subjects from choosing CEO to protection from brand imitation. However detective companies are awaiting legal regulation.

Now private detective firms are becoming research units of companies. Companies have started to receive help from detectives in several subjects from personal background researches of top executives to the solution of nonperforming loans. Number of companies applying for 14 detective firms rendering service in Turkey in 2007 has exceeded 250. If the law regulating detective work is introduced, it is stated that the number of detectives will increase from 300 to 5 thousand. Detective services are commonly given not only on individual but also corporate level on the world. Services have been regulated by laws. However there is not a law in Turkey yet. But the demand coming from foreign companies, the number of which has been increasingly rising also increases the number of these companies.

Increase in the number of 3^rd generation industrialists and businessmen in Turkey are an important factor for the increase in demand for detectives. Now number of detective firm which has reached corporate level is 14. Research personnel, agency and detectives, the numbers of which are close to 300 are recruited in these companies.

DETECTIVE PURSUIT FOR FAMILY VIOLENCE

Observors will follow spouses who commit violence, who are alcoholic or gamblers.

Presidency Family and Social Researches General Directorate has prepared a new report called ‘A Research On the Evaluation of Law and Practices Regarding Protection of Family’. In the report, it has been stated that the spouse who was temporarily dismissed from house was not adequately followed, and as a result cases of violence have continued. In the report it has been recommended that an observer trusted by parties or appointed by the court is assigned for the problems to be solved. It will be paid attention that the person undertaking the task of pursuit is loved, trusted and respected by the spouses.   

Step-by-Step Pursuit

According to this, if the spouse temporarily dismissed from house through court decree complies with the law or not shall be regularly inspected through pursuit by the person assigned. If the court has detected that the violence is caused by alcohol or drug addiction and has put a ban in this regard, it will be followed by the observer if the spouse complies with this ban or not. It will also be followed if bans such as gambling or damaging an item are applied as well as controlling a spouse forbidden from carrying gun or a cutter due to his/her inability to control his/her anger. Control of the spouse hindering his/her subsistence liability will be made by the person responsible for the pursuit. Responsible people will issue a minute about the spouses not applying the measures put by the court and shall notify the prosecution of the situation. Spouses which have been complained via petition will be charged with imprisonment from 3 months to 6 months.

In the report interrogating the reasons of family violence and containing measures against this, the detection for the person to be assigned with pursuit is as follows: ‘… It has been found out the decisions given by Family court are not followed, and it is not even possible. Reporting/minute system which is efficient and open to auto control can be developed. Following the court decree, people who are close to the family and appointed by the judge can be assigned. Recording of injunction to GBT would facilitate the pursuit of these decisions…’

Assurance even Without Marriage

Also in the report, ‘Living together without marriage’ is seen as a real phenomenon existing in the social life. Also in these relationships, women and children may be exposed to violence. So it has been said that regulations to help individuals living together without an official marriage get protected from the damages must be included.

  INTERPOL HAS WARNED AGAINST FAKE MEDICINE SALES

International Police Constabulary Interpol warned all the consumers that fraudulent may sell fake medicine by exploiting swine flu crisis.  

In the explanation made on 01^st May 2009 from the constabulary, the centre of which is in the city of Lyon in France, they stated that the 3 percent-4 percent of the spam e-mails are lately about swine flu and this number is expected to increase.

 Interpol stated that fraudulent are exploiting the situation about the swine flu for their own financial interests and the current situation is advantageous for fraudulent who search for people who are worried about their health. Interpol stated that people must be very careful about those spam e-mails which provide them medicine and information about swine flu.

DETECTIVES ARE COMING FOR YAZICIOĞLU ACCIDENT

BBP has been having a detective brought from Germany and experts from three countries.  

For the research of the death of Muhsin Yazıcıoğlu who lost his life together with 5 people in the helicopter, it has been found out that a BBP has started to see a detective office in Germany. In the accident pre-report explained by the Ministry of Transportation, bad weather conditions and pilot's mistake did not satisfy people from BBP as justifications of the accident.

BBP Vice President Ahmet Şanverdi said these to VATAN: "A team has come from Germany to investigate the accident. A new team will come from Germany approximately after a week. Subsequently, teams will come from USA and Canada for accident investigation. We will get 4 accident reports from these teams. We will have 5 reports together with the report of Ministry of Transportation. And also, for the case to be investigated, our friends have started to talk with detective offices in Germany.”

It will be investigated in a closed area

Şanverdi who stated that experts from German Federal Aviation Association started the investigations said that "Experts will recollect the wreckage in a closed area and investigate". The proposals about the Parliamentary research explanation about the helicopter accident because of which Muhsin Yazıcıoğlu lost his life will be dealt with in TBMM today. Research proposals of AKP, MHP and CHP regarding the subject will be united in TBMM General Assembly and will be discussed. Levent İÇGEN
